*HC grants CBI remand of Amit Shah*
Ahmedabad, Aug 6 (IBNS): The Gujarat High Court on Friday granted the
Central Bureau of Investigation (CBI) two days custody of former state
minister Amit Shah in the 2005 Sohrabuddin Sheikh fake encounter case.
Justice Akil Qureshi granted Shah’s custody to CBI, a day after the
investigating agency moved the High Court challenging a special CBI court’s
refusal to grant CBI remand of Shah.
On Wednesday, additional chief judicial magistrate AY Dave had rejected the
CBI’s plea for custody of Shah in the fake encounter case.
The CBI had maintained that Shah had not cooperated with the investigating
agency when it was allowed to question him for three days while in judicial
remand in Sabarmati jail, where he is currently lodged.
The court, rejecting the remand plea, had said, “In light of the
constitutional rights of the accused, based on this short note (by CBI), to
assume primarily that (Shah) is an accused would not be proper.”
“In view of the facts, also there are no substantial grounds with the CBI
to seek remand of the accused (Shah).”
A former Gujarat minister of state for Home, Shah is among the accused in
the Sohrabuddin Sheikh and his wife Kausar Bi’s fake encounter case.
