SC verdict slap on UPA: BJP



New Delhi, Jan 31 (IBNS)  Political reactions are pouring in since Tuesday morning's  Supreme Court verdict on prosecution sanctions for government officials and ministers with the main opposition BJP calling it a slap on the face of the ruling UPA and the Congress calling it a premature interpretation as "irresponsible". 


In a big blow to the UPA government, the Supreme Court on Tuesday said sanctions against prosecuting a government servant or minister from the competent authority should come within three months and if no response comes within four months it will be taken as deemed and the case against the official can be carried forward.

The Supreme Court  thus accepted Janata Party president Subramanian Swamy's petition against the Prime Minister's Office in the 2G spectrum allocation scam case.


Senior Bhartiya Janata Party (BJP) leader and spokesperson Ravi Shankar Prasad said the judgement is a "serious indictment to the functioning of the UPA and working of PMO."

"In that case it's a good sign."

Congress spokesperson Manish Tiwari said the party would not make any irresponsible comment without perusing it properly.

"Well, I am extremely awkward that a responsible national party [BJP] can criticise without reading the judgement of Supreme Court."

"I think the lawyers would read the judgement."

He said Congress will not say anything irresponsibly without reading it. He said it was extremely irresponsible of BJP to exterpolate from the judgement. 

Minister of State in Prime Minister's Office (PMO) V. Narayanswamy said, "It's not a setback for the government. Several judgements are coming  from the court about various issues. Parliament should frame the guidelines."

Earlier, Subramanian Swamy said: “It is victory for Constitution." 

The apex court verdict also said that there is no need to obtain sanction for instituting inquiry against any official, Swamy said. 


Swamy had filed a petition before the Prime Minister seeking sanction to make former telecom minister A Raja stand trial in the 2G case. 

Swamy made a scathing attack on Union Minister Kapil Sibal (Human Resource and Telecom) and Salman Khurshid (Law) for holding that not anybody can go the PM with request for sanction, asking them to go back to law school and calling them as “semi-literates”. 

“The court has put a time limit, asked government to amend the Constitution and Prevention of Corruption Act,” said Swamy.

“Anybody can get an inquiry conducted by the court without having sanction, sanction is needed at the stage of trial not inquiry,” said Swamy. 

He said the court deprecated the tendency of many sanctioning authorities to delay matters. 

The court did not accept the centre’s view point that everyone cannot approach the prime minister, he said. 

“The ministers should learn law again going to the law school. The court said everyone has a right to reach the PM directly,” Swamy said.
